Welcome to Brandnea.com (“we,” “our,” or “us”). By accessing or using our website, services, or communications channels (including SMS text messages and phone calls), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully before using our services.


1. Overview of Services

Brandnea.com provides services related to:

  • The sale of premium and geo-targeted domain names.
  • Domain brokerage and resale services.
  • Connecting buyers and sellers for domain acquisition.
  • Related customer support and business communications.

Our services are primarily business-to-business (B2B) and are intended for adults aged 18 and older.


2. Communications and Consent

By submitting a contact form, scheduling a consultation, calling us, or otherwise providing your contact information (including a business phone number), you consent to receive the following from Brandnea:

  • Phone calls (which may include the use of an automated system and/or artificial or prerecorded voice for identification, routing, or follow-up).
  • SMS or MMS text messages regarding domain availability, offers, and related services.
  • Follow-up emails or voicemails related to your inquiry or our outreach.

Our standard follow-up process (for unanswered calls): If we call a number and there is no answer, we may leave a prerecorded voicemail identifying our business and purpose, and then send a follow-up SMS to the same number. That SMS may reference domain availability, interest checks, pricing, or scheduling options. You can opt out at any time (see below).

Message Frequency: Messages are sent periodically in connection with inquiries or B2B outreach.
Message & Data Rates: Standard carrier message and data rates may apply.
Opt-Out: You may opt out of SMS at any time by replying STOP. For help, reply HELP. You may also request no further calls or texts by telling us during any call or emailing info@brandnea.com with the subject “Do Not Contact.”
Consent Not a Condition: Consent to receive calls or texts is not a condition of purchase or service.

Contact Form Consent (for clarity): Our contact form includes a required consent statement (radio/checkbox) that states: “By submitting, you agree to receive calls and text messages from Brandnea about available domains. Msg & data rates may apply. Reply STOP to opt out.” Submitting the form records your consent.


3. Twilio Messaging and Calling Compliance

We use Twilio to facilitate business communications (calls, SMS, and automated call handling). We implement reasonable processes intended to comply with applicable rules and industry guidelines, including:

  • The Telephone Consumer Protection Act (TCPA) and related FCC rules.
  • CTIA messaging principles and best practices.
  • Federal and state Do-Not-Call (DNC) requirements and applicable anti-spam laws.

We do not use our systems for abusive or deceptive practices. Each outreach includes clear identification and an opt-out mechanism. We respect local calling/texting hours and maintain internal processes for honoring opt-out requests promptly.


4. User Responsibilities

By engaging with Brandnea.com, you agree that:

  • You will only provide accurate and lawful information.
  • You are authorized to represent the business whose contact information you provide.
  • You understand that communication records may be stored to document compliance and consent.

You also agree not to use our services for any illegal, abusive, or harassing activity.


5. Opt-Out and Do-Not-Call Policy

You may request to be removed from our contact lists at any time by:

  • Replying STOP to any SMS message;
  • Emailing us at info@brandnea.com with the subject line “Do Not Contact”;
  • Requesting removal verbally during any phone call.

We maintain an internal Do-Not-Call list and will honor your opt-out request within a reasonable time (typically within 24–48 hours). Opt-out status applies to both calls and texts from Brandnea.


6. Automated System, Voicemails, and Recording

Automated System: Inbound calls to Brandnea may be answered by an automated system that identifies our business and purpose and can route or schedule a callback. Outbound calls may use automation for call initiation or identification when permitted by law.

Voicemails & SMS Follow-Up: If a call is not answered, we may leave a prerecorded voicemail and send a follow-up SMS related to domain availability, interest checks, pricing, or scheduling.

Recording Notice: Calls may be recorded for training, quality assurance, and compliance. Where required by law, a disclosure will be provided at the start of the call. Continuing the call constitutes consent to recording.


7. Cold Outreach to Publicly Listed Business Numbers (B2B)

As part of our B2B services, we may contact publicly listed business numbers to inquire about interest in domain names. All such outreach includes clear identification of Brandnea and an immediate opportunity to opt out of further calls or texts. If you receive a call or message in error or prefer no further contact, please reply STOP (for SMS) or notify us by phone or email, and we will add your number to our internal Do-Not-Call list.


8. Purchasing and Transactions

All domain purchases, offers, or transfers are governed by our separate Sales Agreement (provided during checkout or through escrow). Payments may be processed through third-party providers such as Escrow.com or Dan.com. All domain transfers comply with ICANN policies and registrar requirements.


9. Intellectual Property

All materials on Brandnea.com—including text, images, and domain name listings—are protected by intellectual property law. You may not copy or reproduce our content without written permission.


10. Limitation of Liability

We are not responsible for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the total amount you paid for a service within the past 12 months.


11. Privacy Policy

Our Privacy Policy explains how we collect, use, and protect your personal information, including phone numbers and email addresses. By using our services, you acknowledge and agree to our data collection, retention (including opt-in/opt-out logs), and storage practices.


12. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes shall be handled in the appropriate courts of Orange County, California.
